Publication Acceso a la justicia a través de demandas electrónicas en México(Universitat Oberta de Catalunya, 2024); ; Saavedra Salazar, José AntonioAcceder a la justicia a través de medios electrónicos promete acercar la justicia a la ciudadanía. Sin embargo, no basta con que los poderes judiciales cuenten con plataformas para el juicio en línea si su utilización es marginal. La investigación sobre juicios en línea con apoyo estadístico es escasa. Existe una plataforma que permite presentar demandas electrónicamente ante órganos jurisdiccionales de la República Mexicana desde cualquier parte del mundo que tenga conectividad a internet. Por lo que este artículo analiza la utilización de demandas electrónicas a nivel nacional y a nivel de estados de la República Mexicana de 2019 a 2023, así como su correlación con el Producto Interno Bruto per cápita de servicios profesionales, científicos y técnicos (PIBpc-SPCyT). Con datos oficiales se: 1) analiza la evolución por cada 100 mil habitantes, como proporción del total de demandas y con base en la tasa de crecimiento anual compuesta; y 2) se establece la correlación e impacto de las demandas electrónicas con el PIBpc-SPCyT. Se halló que existe un incremento constante en el uso de las demandas electrónicas y que obedece a distintos factores, así como que hay una correlación directa entre el PIBpc-SPCyT y la presentación de demandas electrónicas. ©Los autores ©IDP. Publication Análisis de la sentencia de la Suprema Corte de Justicia que valida el matrimonio entre personas del mismo sexo(2011)Es un análisis de la Sentencia del Pleno de la Suprema Corte de Justicia (dictada en sesión del 5 de octubre de 2010), que declaró que la reforma del Código Civil del Distrito Federal que admite el matrimonio entre personas del mismo sexo, es conforme con la constitución mexicana. El análisis pretende destacar las principales argumentos que da la Corte para llegar a sus conclusiones, que en mi opinión pueden reducirse a estas: la constitución protege “la familia”, pero no un solo tipo de familia, sino todos los tipos de familia existentes; el concepto de matrimonio no es inmutable, y por lo tanto el legislador puede cambiarlo; el matrimonio celebrado en el Distrito Federal tendrá que ser respetado en todos los estados de la República; la reforma del matrimonio se justifica por razones de igualdad y no discriminación; el derecho al libre desarrollo de la personalidad implica respetar la preferencia sexual. De cada uno de estos argumentos se hace una crítica. Publication Assertiveness and Human Rights Origins, Exercise, Education and Duties: How Assertiveness Can Help Us Better Understand Human RightsThis chapter will explore the relationship between assertiveness and human rights. The concept of “rights” is present in many definitions of “assertiveness”, in that being assertive means standing for one’s rights in a particular manner. In that sense, the author begins by explaining the origins of the relationship between the two concepts. Afterwards, he analyses the connection between human rights and assertiveness through three aspects that help better understand both ideas: first, what it means to exercise a right; second, how assertiveness can be explained through human rights education; and lastly, he suggests that to comprehend the two ideas better, it is necessary to also think in terms of “human duties”. ©The author. ©Springer. - Some of the metrics are blocked by yourconsent settings
Publication Assessing AI-Generated Legal Reasoning: A Benchmark for Legal Text Quality from Literature ReviewThe adoption of Large Language Models in law has sparked debate over how best to evaluate AI-generated legal reasoning. Existing benchmarks focus on surface-level accuracy, overlooking deeper dimensions such as argumentative coherence, practical usability, and alignment with jurisprudential values. This paper provides a comprehensive framework that integrates insights from formalism, interpretivism, realism, and argumentation theory to assess legal AI outputs. We first explore the philosophical foundations of legal reasoning, drawing on MacCormick’s concepts of internal and external justification and Perelman’s notions of audience-centered persuasion to highlight the rhetorical and moral dimensions essential for evaluation. Next, we examine structured approaches to evaluation from related fields before showing why existing benchmarks (e.g., LexGLUE, LegalBench, LegalAgentBench) only partially capture the subtleties of legal reasoning. We also contrast common law and civil law traditions to illustrate how a one-size-fits-all approach neglects the distinct roles of precedent versus codified statutes. Building on these theoretical and comparative insights, we propose a three-stage evaluation methodology that begins with automated screening for factual consistency, proceeds to expert-led rubric assessment across five dimensions (Accuracy, Reasoning, Clarity, Usefulness, and Safety), and concludes with iterative refinement through reliability checks. This structured approach, validated through a pilot study, aims to strike a balance between scalability and nuance, equipping researchers and practitioners with a robust tool for assessing AI-generated legal texts. Publication Assessing the interdependence among renewable and non-renewable energies, economic growth, and CO2 emissions in Mexico(2021) ;Venegas-Martínez, FranciscoThis paper is aimed at examining the short- and long-run relationships among consumption of renewable and non-renewable energies, economic growth, and CO2 emissions in Mexico during the period 1973–2018. Data were obtained from the World Bank and the British Oil Company BP. A cointegration model together with a fully modified ordinary least squares (FMOLS) is used to estimate possible associations among all variables. Subsequently, the Granger causality test is applied to empirically verify the environmental Kuznets curve (EKC) hypothesis. The main empirical results are that the variables under study explain CO2 emissions in the short and long run, with economic growth having the greatest influence on CO2 emissions, which provides empirical evidence of an EKC for Mexico. Moreover, consumption of renewable and non-renewable energies and economic growth causes in the Granger sense the current levels of CO2 emissions. Moreover, lagged GDP and lagged non-renewable energy consumption do influence (Granger cause) current CO2 emissions. Children audiences in free-to-air television needs to be protected through schedules during which only suitable contents for children of different ages is allowed. The schedules must remain as long as there is no parental control for free-to-air television, and which is generally available to the people. Publication Causal Artificial Intelligence in Legal Language Processing: A Systematic ReviewRecent advances in legal language processing have highlighted limitations in correlation-based artificial intelligence approaches, prompting exploration of Causal Artificial Intelligence (AI) techniques for improved legal reasoning. This systematic review examines the challenges, limitations, and potential impact of Causal AI in legal language processing compared to traditional correlation-based methods. Following the Joanna Briggs Institute methodology, we analyzed 47 papers from 2017 to 2024 across academic databases, private sector publications, and policy documents, evaluating their contributions through a rigorous scoring framework assessing Causal AI implementation, legal relevance, interpretation capabilities, and methodological quality. Our findings reveal that while Causal AI frameworks demonstrate superior capability in capturing legal reasoning compared to correlation-based methods, significant challenges remain in handling legal uncertainty, computational scalability, and potential algorithmic bias. The scarcity of comprehensive real-world implementations and overemphasis on transformer architectures without causal reasoning capabilities represent critical gaps in current research. Publication Clemente de Jesús Munguía Núñez (Mexico, 1810–68)(2021)This chapter offers a synthetic exposition of the main features of the life and work of Clemente de Jesús Munguía, known mainly for his tenacious work defending the rights of the Catholic Church against the secular liberal state, and for his writings of philosophy and theology. The biography is divided into three stages. The first (1810–40) corresponds to his childhood and youth and concludes with his graduation as a lawyer and his early professional practice in Morelia and Mexico City. The second (1841–51) begins with his ordination as a priest and continues with his work as rector at the Seminary of Morelia, where he profoundly reformed the curriculum and wrote his most important books on theology and moral philosophy. The third stage (1852–68) begins with his ordination as Bishop of Morelia, which generated political controversy over the oath that the government required for him to be ordained; this stage continues with his constant defense of the rights of the Church against the excessive pretensions of liberal governments and the government of Emperor Maximilian, and it concludes with his exile and death in Rome. ©2021 Routledge.Scopus© Citations 3 40 1
