    This thesis provides a foundational legal analysis of smart contracts within the context of business-to-consumer (B2C) e-commerce under Mexican law, addressing the legal uncertainty created by this emerging technology. The author argues that while smart contracts offer efficiency and automation, their self-executing nature presents significant challenges to traditional legal principles of contract formation, particularly concerning consent, legal capacity, and consumer protection rights established in the Federal Consumer Protection Law. Through a doctrinal and analytical methodology, the work examines the technical components of smart contracts and assesses their compatibility with Mexico's existing civil and commercial legal frameworks, highlighting the risks of consumer vulnerability due to the immutability of the code and the lack of clear recourse mechanisms. The thesis concludes that the current Mexican legal system is insufficient to adequately regulate smart contracts in B2C relationships and proposes the creation of a specialized legal framework, encapsulated in a new "Law for the Regulation of Smart Contracts," to provide legal certainty, protect consumer rights, and foster the responsible adoption of this technology.
