Abstract
This thesis, "TRANSFERENCIAS ELECTRÓNICAS Y EL PAPEL DE LOS BANCOS EN LA PROTECCIÓN AL USUARIO" (Electronic Transfers and the Role of Banks in User Protection), examines the problem of electronic fraud resulting from a lack of adequate protection for banking clients. The research is based on the hypothesis that unauthorized electronic transfers are a consequence of insufficient diligence on the part of banking institutions, and that effective measures are necessary to prevent these frauds from undermining the benefits of electronic transactions. The study uses comparative, systematic, historical, and nomological methods to analyze national and international regulations, including legal precedents and financial doctrines. The author identifies a significant increase in cyber fraud, noting that 92% of cases occur in e-commerce, with over 4.2 million claims reported in the first half of 2022. The work concludes that an asymmetric relationship exists between banks and their clients, in which banks possess superior knowledge and resources. As a result, the thesis proposes that banks must fulfill a greater duty of diligence by investing in advanced technology, improving fraud detection systems, and providing faster responses to claims. The ultimate goal is to strengthen legal protections and promote financial education to safeguard users in the digital banking environment.
