Abstract
This thesis examines the unconstitutionality of labor subcontracting (outsourcing) in Mexico, arguing that this practice fundamentally violates the social and labor rights enshrined in Article 123 of the Mexican Constitution. The author traces the historical evolution of labor rights from the Mexican Revolution and the Constitution of 1917, contrasting these foundational principles with the negative impacts of outsourcing, which was formally regulated in the 2012 labor reform. The work contends that subcontracting has been used as a mechanism to simulate labor relations, thereby depriving workers of essential rights such as job stability, social security benefits (including housing and retirement funds), profit-sharing, and the right to unionize. By analyzing the doctrinal foundations of Mexican labor law and relevant judicial precedents, the thesis concludes that outsourcing represents a regressive measure that undermines the dignity of the worker and proposes legislative reforms to eradicate these harmful practices and restore the protective spirit of the Constitution.
