Abstract
This thesis analyzes the legal nature of personal data under Mexican law, arguing that the current legislative framework's failure to provide a clear definition creates significant legal uncertainty and undermines effective protection. The author critiques the prevailing reliance on the principle of "informative self-determination," positing that it is an ambiguous and insufficient foundation to address the complex challenges posed by the digital economy, including Big Data and artificial intelligence. The central argument proposes a fundamental shift: legally reclassifying personal data as an "attribute of the personality" (atributo de la personalidad), thereby intrinsically linking its protection to the core principle of human dignity. Through a doctrinal and comparative analysis, the work concludes that defining the legal nature of data is a necessary prerequisite for any meaningful reform and proposes specific legislative amendments to formally recognize it as an attribute of the personality, thus resolving a critical deficiency in Mexico's legal system.
