Abstract
This thesis argues for the necessity of creating a specialized Constitutional Tribunal in Mexico, contending that the current Supreme Court of Justice of the Nation (SCJN) is overburdened and compromised by a flawed hybrid model. The author posits that the SCJN's dual functions—acting as both the head of the ordinary judiciary handling legality appeals and as the primary body for constitutional control—results in an excessive workload that prevents it from effectively fulfilling its constitutional mandate. This problem is exacerbated by the highly politicized appointment process for justices, which relies on the President and Senate, thereby undermining the Court's independence and autonomy. Through a comparative analysis of other judicial systems, the thesis concludes by proposing the establishment of a new, autonomous Constitutional Tribunal, separate from the regular judiciary, which would be exclusively dedicated to constitutional matters and staffed through a depoliticized, merit-based selection process.
