Abstract
This thesis, "La necesidad de derogar la adopción simple en Jalisco" (The need to repeal simple adoption in Jalisco), argues for the elimination of the simple adoption framework within the Civil Code of the State of Jalisco, advocating for plenary adoption to be the sole legal avenue. The research begins by defining adoption, exploring its legal nature, tracing its historical roots from Roman law to modern Mexico, and detailing the requirements and effects of both simple and plenary adoption as currently regulated in Jalisco. It then examines the evolution and scope of children's rights, both internationally (e.g., Convention on the Rights of the Child) and nationally (e.g., Mexican Constitution Art. 4, General Law on the Rights of Children and Adolescents), focusing on the best interests of the child principle. The core argument posits that simple adoption, due to its characteristics—limited legal ties (only between adopter and adoptee), lack of full integration into the adopter's family, failure to sever ties completely with the biological family, and notably, its revocability—inherently violates fundamental children's rights, including the right to identity, a stable name, and legal security and certainty, thus contravening the best interests principle. Through a comparative analysis, the thesis shows that the federal government and the majority of Mexican states have already repealed simple adoption, recognizing plenary adoption as the superior mechanism for ensuring the child's welfare and complete family integration. Consequently, the thesis proposes the formal repeal of Articles 543 to 550 of the Jalisco Civil Code to align the state's legislation with national trends, international standards, and the constitutional mandate to prioritize the child's best interests.
