Abstract
This thesis analyzes the legal and patrimonial consequences for cohabitation (concubinato) in Mexico following the Supreme Court of Justice of the Nation's redefinition of marriage as an exercise of the right to the Free Development of Personality. It argues that by grounding marriage in this judicially-created right—based on individual autonomy in choosing a life plan—the Court has inadvertently established the same legal foundation for cohabitation, a de facto union. Despite this shared origin, the thesis highlights the significant contradictions and legal uncertainty arising from the disparate regulation of their respective economic regimes, including the distribution of assets upon separation, alimony, and inheritance rights. The work scrutinizes how this inconsistency creates a state of vulnerability and potential discrimination for cohabiting partners, who are often denied the legal protections and benefits afforded to married couples, ultimately questioning whether a legal distinction between the two institutions remains justified under this new judicial paradigm.
