Abstract
This thesis addresses the growing phenomenon of Third-Party Funding (TPF) in international arbitration, a financial tool that, while enhancing access to justice by covering high procedural costs, introduces significant legal and ethical challenges. The author examines the key dilemmas arising from TPF, including potential conflicts of interest involving arbitrators, breaches of confidentiality, undue funder influence over proceedings, and complications regarding security for costs and final cost allocation. The central argument posits that a mandatory duty to disclose the existence and identity of a third-party funder is a crucial mechanism for mitigating these risks and preserving the integrity of the arbitral process. Through an extensive analysis of existing state legislation, institutional rules from leading arbitral bodies, international investment agreements, and key arbitral precedents, the research evaluates the varying scope and effectiveness of current disclosure requirements. Ultimately, the thesis proposes a model regulation for the disclosure obligation, aiming to strike a balance that ensures transparency and protects procedural integrity without unduly burdening the legitimate interests of the funded party and the funder.
