Abstract
This doctoral thesis, titled "COMPETENCIA Y COMPLEMENTARIEDAD ENTRE LA JUSTICIA CONSTITUCIONAL Y EL SISTEMA INTERAMERICANO DE DERECHOS HUMANOS: EL CASO DE LOS PUEBLOS INDÍGENAS DE AMÉRICA LATINA" (Competition and Complementarity between Constitutional Justice and the Inter-American Human Rights System: The Case of Indigenous Peoples in Latin America), analyzes the relationship between national constitutional justice and the Inter-American Human Rights System (IAHRS) concerning the protection of indigenous peoples' rights. The study explores the historical evolution of indigenous rights in Latin America and the legal frameworks that seek to protect them, arguing that these two systems of justice should not be seen as rivals but as complementary bodies that strengthen each other. The thesis uses a historical-analytical methodology to examine how the IAHRS has addressed the specific rights of indigenous communities, such as their rights to territory, collective property, and consultation, and how these decisions have influenced constitutional courts in the region. The author concludes that, for the effective protection of indigenous rights, a cooperative and complementary dialogue between national courts and the Inter-American Court of Human Rights is essential, as this approach contributes to the consolidation of a more robust, pluralistic, and inclusive legal order that respects the identity and culture of indigenous peoples.
