Abstract
This thesis, titled "LA FE DE HECHOS Y LA PROTECCIÓN DE DERECHOS LABORALES DE MIGRANTES NO DOCUMENTADOS EN GUANAJUATO" (The "Fe de Hechos" and the Protection of Labor Rights of Undocumented Migrants in Guanajuato), addresses the critical issue of labor rights violations faced by undocumented migrants in Guanajuato's agricultural sector. The central hypothesis is that a "Fe de Hechos" (Statement of Facts), a notarized document, can serve as a crucial legal tool to protect these workers' rights. The research employs a historical-analytical and legal-procedural methodology to examine the vulnerable position of undocumented migrants, who often fear reporting abuses due to their legal status. The thesis concludes that the "Fe de Hechos" provides a viable mechanism to document workplace exploitation—such as unpaid wages, excessive working hours, or lack of safety measures—without requiring the migrant to disclose their immigration status. This public instrument, which legally records objective facts, can be used as concrete evidence in a labor dispute, thereby empowering migrants to seek justice and strengthening the protection of their fundamental labor rights.
