La institución de la esclavitud en Nueva España y la rebelión de Yanga : un análisis jurídico-político

La institución jurídica de la esclavitud se implementó en la Nueva España a la par que se importaban personas de África. Pese a la protección de la Corona española a los indígenas en el marco del proceso de evangelización, los individuos de raza negra fueron mantenidos en un estado de privación de la libertad. Desde finales del siglo XVI, se detectaron insurrecciones de esclavos, consecuencia de su posición en el último escalafón del entramado de castas. En 1609 surgió una rebelión en Veracruz que destacaba por su organización y cadena jerárquica demando, comandada por Yanga. La inicial actitud conciliadora del virrey Luis de Velasco, quien buscaba evitar erogaciones innecesarias, se vio sustituida por una intervención militar que culminó con un pacto que dio origen al primer pueblo libre del continente, cuya naturaleza jurídica era foral. ©2017, Universidad Panamericana, Facultad de Derecho.

The legal institution of slavery is brought to Nueva España along with the people imported from Africa. Despite the protection of the Spanish Crown to the indigenous population in the context of the evangelization process, people of African origin were deprived of their liberty. In the late 16th century, slave insurrections arose, due to their position at the bottom of the social structure of castas. In 1609, a rebellion began in Veracruz, characterized by its organizationand chain of command, led by Gaspar Yanga. The pragmatic and prudent attitude of the Viceroy Luis de Velasco, to avoid unnecessary public spending, turned into a military intervention that culminated with a pact that gave origin to the first free town in the American continent, that had an ex gratia legal nature. ©2017, Universidad Panamericana, Facultad de Derecho.
