El artículo retoma la teoría de Agamben sobre el homo sacer y se plantea si hoy día podemos encontrar ejemplos biojurídicos de nuevos homines sacri. Tras responder afirmativamente a esta pregunta, el trabajo explora en las raíces de la violencia legal y ofrece tres vías para la superación del paradigma biopolítico. ©2017, Universidad Panamericana, Facultad de Derecho.
The paper takes over the theory of Agamben about the homo sacer and wonders if, today, biolegal examples of new homines sacri can be found in our Law. After a positive answer to this question, the article explores the roots of legal violence and suggests three ways of getting over the biopolitical paradigm. ©2017, Universidad Panamericana, Facultad de Derecho.
