Item type:Publication, La cláusula partidocrática para la reelección en el congreso de la unión: un análisis crítico.(2022) ;Padilla Bedova, Jesús RodolfoGatt Corona, Guillermo A.This thesis presents a critical analysis of legislative reelection in the Mexican Federal Congress, focusing specifically on the "partidocratic clause" established in Article 59 of the Constitution following the 2014 political-electoral reform. Through a historical review ranging from the Constitution of Cadiz to the present day, and a comparative study with the United States' electoral system, the author argues that the current regulation—which conditions reelection on the nomination by the same political party unless the legislator resigns halfway through their term—strengthens party control (partidocracy) to the detriment of the legislator's accountability to the electorate. Consequently, the research concludes that to achieve true professionalization and independence of the Legislative Power, it is necessary to eliminate this restrictive clause, allow reelection regardless of the election principle (majority or proportional), and implement a staggered renewal system for the Senate every three years. - Some of the metrics are blocked by yourconsent settings

Through a comprehensive review of the national regulatory framework—including the General Health Law and tax regulations—the study identifies the Juicio de Amparo as the ideal legal mechanism to defend this right against legislative omissions and administrative negligence. UN ANÁLISIS JURÍDICO", realiza un análisis legal estricto de la Guardia Nacional (GN), creada como respuesta a la crisis de inseguridad y violencia en México. El estudio examina la naturaleza, integración y régimen de la GN a la luz del marco constitucional mexicano (específicamente el Artículo 21), el derecho internacional de los derechos humanos y el derecho comparado. La tesis argumenta que existe una "incongruencia" fundamental: aunque la Constitución establece la GN como una "corporación policial civil" , en la práctica está "integrada por las policías militar y naval" y su estructura y actuar son "de carácter militar". Esta contradicción, concluye el análisis, hace que la GN sea inconstitucional, al violar la clara separación entre seguridad pública civil y las fuerzas armadas , e inconvencional. El estudio argumenta que el marco legal actual, si bien incluye una Ley General y un Sistema Nacional de Búsqueda , resulta insuficiente debido al diseño institucional deficiente de la Comisión Nacional de Búsqueda (CNB). Al ser un órgano desconcentrado y jerárquicamente dependiente de la Secretaría de Gobernación (SEGOB), la CNB carece de la independencia y autonomía real necesarias para operar con eficacia , quedando sujeta a presiones e intereses políticos. The study evaluates Article 102 of Mexico's Migration Law using the standards set by Article 5 (Right to Personal Integrity) and Article 22 (Freedom of Movement and Residence) of the American Convention on Human Rights. The thesis contends that the barriers to regularization and work established in Article 102 (such as requiring a citizen sponsor) deny migrants a dignified livelihood, forcing them into exploitation, trafficking, and precarious conditions that violate their personal integrity (Art. 5).
