Abstract
This thesis, "LA PROTECCIÓN DE LA FAMILIA Y EL DERECHO AL TRABAJO DE HOMBRES Y MUJERES A TRAVÉS DE LAS LEYES MEXICANAS," investigates the significant inequity in work-life reconciliation policies within Mexican legislation , arguing that current laws fail to meet the needs of modern families. The study analyzes how the existing legal framework, including the Constitution and the Federal Labor Law , perpetuates gender inequality by imposing labor penalties on women (e.g., wage gaps, career interruptions after childbirth) while simultaneously restricting men's participation in family life due to limited paternity leave and cultural "provider" roles. Utilizing a comparative analysis of more advanced reconciliation strategies in Chile, Colombia, and Sweden , and examining international standards like ILO Convention 156 (on family responsibilities) , the thesis concludes that Mexico's current provisions are insufficient and proposes the creation of a national strategic plan centered on parental co-responsibility (corresponsabilidad parental) to ensure both men and women can effectively balance their professional and family rights.
