Item type:Publication, Hands up, Bozo! The difficulties of arresting humourHumour is an elusive topic within the legal sphere. Contemporary discourse frequently struggles with whether comedians should be legally accountable for their often-controversial humour, juxtaposing the intricacies of humour’s nature against the principle of free speech. This article aims to demonstrate the inadequacy of judicial resources in addressing humorous expressions. Initially, I examine the varied judicial treatments of humour across different legal systems. Subsequently, I highlight the inherent difficulties in criminalizing humour, whether through aesthetic judgments or evaluations of the comedian's intentions, as both tend to result in an excessive interpretation of the performer’s expression and motives. In the third section, I critique the models proposed by Godioli and Mosaka, discussing the benefits and limitations of these frameworks in establishing a legal standard for assessing when humour crosses the line and its adjudication in court. Ultimately, I contend that humour, particularly that of comedians, ought to be evaluated from a societal perspective, exempting it from legal constraints. I propose alternative solutions to confront offensive humour that bypass formal justice systems, such as enhancing media literacy, endorsing comedians who champion social values, and deterring the patronage of certain comedic genres. ©The author ©The European Journal of Humour Research10 - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Francisco Suárez y la risa barrocaEn su Comentario al De Anima de Aristóteles, Francisco Suárez ofrece una detallada explicación de la psicología y fisiología de la risa, así como de su naturaleza como un acto voluntario y libre. Esto marcó un cambio significativo en la comprensión de la risa, la cual, hasta entonces era considerada como una reacción fisiológica sin moderación. En el presente artículo defiendo que la filosofía de Francisco Suárez influyó en la creación del paradigma cultural del Barroco. Suárez on laughter’s voluntariness(2021)In his Commentary on Aristotle’s De Anima, Francisco suárez offers a rich account of the psychology and physiology of laughter. Among other claims, he asserts that laughter is a voluntary act, without giving any further explanation. The aim of this paper is to glean from his texts a philosophically compelling argument for this claim. I will claim that for suárez laughter is a commanded act of the will, since it somehow needs the will’s consent to be elicited. Item type:Publication, Metaphysics and Psychology of the Making of Law in Francisco Suárez(2016)The aim of this paper is to follow Suárez’s metaphysical analysis of action and its relation to the law in order to solve the problems that law poses to human freedom from an ontological standpoint. For this purpose, I will first review Suárez’s account of action, described as a mode intrinsically related to an efficient principle. Then, I will try to show how a human action is a contingent mode, and I will describe the psychological processes whereby it is produced. After stating that the making of law is a human action and therefore a contingent mode, I will discuss whether the law may be considered as a threat to human freedom, for it produces an obligation and introduces some sort of necessity affecting other human actions. Lastly, I will explain how the law guides the citizens by the obligation it produces without harming the contingent existence of their actions. According to Francisco Suárez, action is something that pertains to the realm of efficiency but is in fact distinct from the efficient cause, the effect, and the relation that arises between them. Instead, Suárez initially defines action as the causality of an efficient cause. Item type:Publication, Acción, praxis y ley: Estudio metafísico y psicológico de la acción legislativa en Francisco SuárezLa presente investigación es un estudio monográfico sobre la acción humana y la elaboración de una ley en Francisco Suárez, en la que se intenta abordar de manera sistemática y completa dichos fenómenos. Para ello, primero, se explica qué es la acción y la manera en que comparece en la realidad, según Suárez. En segundo lugar, se justifica que la acción humana en Suárez no es una especie de acción, sino un modo de ella que se distingue por su contingencia; la cual, recibe el nombre de libertad cuando se refiere a la modalidad de la acción que es lograda a través un circuito de actos de las potencias superiores de un agente racional. Por último, se argumenta que la elaboración de una ley además de ser una instancia representativa de una acción humana, también es una acción con la que se afecta las acciones de otros agentes racionales. Item type:Publication, SmilingThis chapter delves into the intricate relationship between smiles, laughter, and human reactions to humor, examining the historical and modern perspectives on these expressions. Traditionally, smiling and laughing were seen as distinct in their moral implications, with smiling often celebrated as classy and tasteful, while laughter was deemed excessive and unpleasant. Recent advancements in neuroscience and psychology, however, challenge this conventional wisdom by revealing different organic underpinnings for these actions and unveiling various types of smiles and laughter. Drawing upon what I call the classical theory of laughter (CTL) and the modern theory of laughter (MTL), I will first explore how our understanding of these phenomena has been reshaped. Then I will argue that despite these transformations, the classical account regarding humoristic laughter remains relevant, and I will highlight the enduring moral implications of these expressions in light of contemporary scientific discoveries. ©The author ©Springer.12 6 - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Recuperación suareciana de los conceptos aristotélicos de δύναμις, ἐνέργεια and ἐντελέχεια(2017)The aim of this paper is to argue that Francisco Suárez doctrine of potency and act should be regarded as an Aristotelian account. I shall revise Suárez's notions of predicamental and transcendental potency and act in order to compare them to Aristotle's account of. Item type:Publication, La voluntad como primer motor creado en Francisco Suárez(2017)El objetivo de este trabajo es mostrar la fundamentación metafísica de la tesis suareciana según la cual, la voluntad es el primer motor de las acciones humanas. La voluntad es una causa eficiente que no está determinada a obrar por ninguna causa eficiente extrínseca: ni por la gracia de Dios, ni por el entendimiento, ni tampoco por la ley o el hado. Todos estos principios activos son sólo una condición necesaria para la acción de la voluntad o, bien, algo que determina el juicio práctico con el que el entendimiento guía a la voluntad, pero ninguno afecta a la voluntad misma. Por otra parte, la teoría suareciana de la potencia y el acto permite explicar la existencia de una causa eficiente capaz de determinarse a sí misma. Item type:Publication, La recepción de la Política de Aristóteles en De potestate regia et papali de Juan de París(2017)La Política de Aristóteles influyó importantemente en los autores del siglo XII en adelante. Sin embargo, en cada caso fue recibida de manera distinta; lo cual, dio lugar a distintas doctrinas políticas. El objetivo de este trabajo es defender que Juan de París interpretó la Política en clave monárquica, a pesar de algunas ideas presuntamente republicanas del autor y a diferencia de otras lecturas hechas por sus contemporáneos. La disyuntiva filosófica detrás del debate entre Eduardo García Máynez y Carlos CossioEn este artículo examino la controversia académica sobre el concepto de libertad jurídica entre Eduardo García Máynez y Carlos Cossio. Defiendo que la discrepancia entre los autores responde a diferencias estructurales que refieren, en última instancia, a dos concepciones distintas acerca de la libertad humana. Para ello, primero, analizo la definición positiva ofrecida por Máynez de libertad jurídica y sus notas esenciales. Luego examino las principales críticas interpuestas por Carlos Cossio a las ideas de García Máynez, así como el modo en el que García Máynez atendió a estas críticas. Finalmente, argumento que la noción de libertad jurídica revela los compromisos libertarios de García Máynez, mientras que las ideas de Carlos Cossio reflejan su concepción compatibilista de la libertad humana. El objetivo final es interpretar la disputa desde una consideración filosófica que no ha sido explorada aún y que permite situar a los autores en discusiones filosóficas más amplias, como la existencia o inexistencia del determinismo causal. ©Doxa.
