Abstract
This thesis, "THE NEED TO PROTECT THE AUTONOMY OF AUTONOMOUS CONSTITUTIONAL BODIES IN MEXICO: THE CASE OF THE NATIONAL ELECTORAL INSTITUTE," examines the historical and legal evolution of autonomous constitutional bodies in Mexico, focusing on the National Electoral Institute (INE) as a case study. The work aims to demonstrate the importance of protecting the INE's institutional autonomy to ensure democratic stability and preserve the rule of law.
The methodology is analytical, historical, and comparative, drawing on legal principles to trace the development of these bodies from the 19th century to the present. The thesis argues that the INE’s autonomy is a cornerstone of the Mexican electoral system, crucial for guaranteeing impartiality, transparency, and certainty in electoral processes. It analyzes key constitutional reforms, such as the 1996 and 2014 changes, which were essential for consolidating the INE's independence from political powers.
The study concludes that, despite continuous attempts by political actors to centralize power, the institutional structure of the INE has proven resilient. However, the thesis warns that recent reforms and political debates pose a constant threat to its autonomy. It highlights the fundamental importance of upholding judicial decisions and protecting the legal framework that safeguards the independence of these bodies. The work underscores that the INE's autonomy is not an end in itself but a means to ensure a fair and democratic electoral process, strengthening the public's trust in the institution and in the democratic system as a whole.
