Abstract
This doctoral thesis, titled "Los valores esenciales que le dan forma y sustento al Federalismo jurídico-positivo" (The Essential Values that Shape and Sustain Legal-Positive Federalism), examines the core values and principles that underpin this form of governance. The research posits that legal-positive federalism is more than a mere political or institutional structure; it is fundamentally sustained by a set of essential values that provide it with coherence and legitimacy. The study analyzes key concepts such as sovereignty, autonomy, and subsidiarity, tracing their historical evolution and their adaptation to modern political and social contexts. By moving beyond a purely formalist interpretation, the thesis argues that a robust and functional federal system requires a dynamic interplay of values such as pluralism, cooperation, and solidarity among its constituent parts. It concludes that the effectiveness of federalism hinges on a collective commitment to these principles, which are crucial for ensuring equitable governance, protecting local diversity, and fostering the common good.
