Abstract
This thesis, titled "LOS PRINCIPIOS DE LAS NACIONES UNIDAS, SUS ORGANISMOS Y EL FRACASO DE LAS SOLUCIONES PLANTEADAS: EL CASO DEL SISTEMA AFRICANO DE DERECHOS HUMANOS Y LA INMUNIDAD DE LAS MISIONES DE PAZ," examines the tension between the principles of the United Nations (UN), its peacekeeping missions, and the African human rights system. The core problem addressed is the impunity and lack of accountability faced by UN peacekeepers who commit human rights violations in African host countries, specifically due to the legal immunity granted to these missions. This immunity prevents victims from seeking justice in local courts, creating a systemic barrier to the protection of fundamental rights.
The thesis argues that while the UN's goals are to promote peace and human rights, the broad immunity granted to its personnel can, paradoxically, lead to a failure to deliver justice to the very populations they are meant to protect. The methodology involves a critical legal analysis of international conventions, UN mandates, and the jurisprudence of the African human rights system. The author proposes that the UN's current legal framework on immunity is incompatible with the principles of human rights, and suggests a revision of these rules to ensure that peacekeepers can be held accountable for their actions. The conclusion is that a more balanced approach is needed to uphold both the operational integrity of peace missions and the right to an effective remedy for victims, thereby preventing the perpetuation of injustice under the guise of international law.
