Abstract
This thesis provides a critical analysis of the procedure for appointing Justices to the Supreme Court of Justice of the Nation (SCJN) in Mexico, arguing that the current system undermines judicial independence and the principle of separation of powers. Through a historical-analytical approach, the study traces the evolution of the appointment process from the 1814 Constitution of Apatzingán to the present, highlighting how the current mechanism, established in Article 96 of the Constitution, grants excessive and discretionary power to the President of the Republic. The author contends that this presidential dominance in nominating candidates, coupled with insufficient qualification requirements under Article 95, politicizes the selection process and compromises the impartiality of the nation's highest court. By comparing the federal procedure with more balanced models in other countries and within certain Mexican states, the thesis ultimately proposes a comprehensive constitutional reform to create a more technical, transparent, and merit-based selection process, aimed at strengthening the autonomy of the SCJN and ensuring its role as a genuine check on political power.
