Abstract
This thesis provides a comprehensive analysis of Mexico's "Restricted Zone"—a constitutionally mandated area extending 100 kilometers along land borders and 50 kilometers along coastlines where foreigners are prohibited from directly owning real estate—arguing that its historical justification is now obsolete and its continued existence creates unnecessary legal and bureaucratic hurdles. Tracing the origins of this protectionist measure to a series of traumatic territorial losses in the 19th century, the work explains how a deep-seated fear of foreign encroachment became embedded in national policy. It then examines the primary legal mechanism established to circumvent this prohibition for investment and residential purposes: the fideicomiso (trust), where a Mexican financial institution holds legal title on behalf of a foreign beneficiary. The investigation critically assesses the practical implementation of this system, highlighting significant inefficiencies, procedural delays, and excessive centralization within authorities like the Secretariat of Foreign Relations and the National Registry of Foreign Investment. Ultimately, the thesis concludes by proposing a constitutional reform to eliminate the Restricted Zone, contending that such a change would streamline foreign investment, reduce legal complexity, and align Mexico's property laws with contemporary global realities.
