Abstract
This thesis provides a legal analysis of surrogacy contracts in Mexico, addressing the significant legal uncertainty and human rights risks created by the absence of a uniform federal regulatory framework. The author argues that the current patchwork of inconsistent and often restrictive state laws, coupled with the legal vacuum at the federal level, fosters a "black market" for reproductive services, leaving all parties—particularly surrogate mothers and the resulting children—in a state of vulnerability. Through a doctrinal examination, the work critiques the limitations of applying traditional civil contract law to surrogacy, highlighting issues such as the potential for an illicit object and the violation of public order. Rejecting both the current unregulated reality and absolute prohibition, the thesis concludes by advocating for comprehensive federal legislation. The author presents a detailed proposal for a law that would regulate altruistic surrogacy, establishing strict requirements for intended parents and surrogates, mandating judicial authorization for agreements, and creating clear rules of filiation centered on the best interest of the child, in order to provide legal certainty and safeguard the dignity and rights of all involved.
