Abstract
This thesis, titled "¿La constitución inconstitucional? La facultad de la suprema corte de justicia de la nación para resolver antinomias en el bloque de constitucionalidad" , critically analyzes the paradigm shift in the Mexican legal system following the June 2011 human rights reform and the controversial ruling by the Supreme Court in Contradicción de Tesis 293/2011. The author challenges the Court's determination that explicit constitutional restrictions must prevail over international treaties, arguing that this interpretation creates an internal contradiction or antinomy within the "constitutionality block" that violates the pro personae principle. Through an examination of the hierarchy of laws and international standards, the research proposes that the Supreme Court indeed possesses the faculty to resolve these conflicts by disapplying constitutional restrictions in specific cases, thereby prioritizing the most protective norm for the individual and effectively reviewing the constitutionality of the Constitution itself.
