Item type:Publication, Constitución política del estado de Jalisco: Garante de un nuevo pacto social(2024) ;Gutiérrez Zaragoza, Juan RaúlGatt Corona, Guillermo A.This doctoral thesis analyzes the necessity of "refounding" the State of Jalisco through the enactment of a new Political Constitution, positioning it as the guarantor of a new social pact capable of addressing the region's contemporary challenges. Through a comprehensive review of constitutional theory, the history of federalism, and the specific constitutional antecedents of Jalisco, the author critiques the current excessive centralization of power by the Mexican federal government, as well as the prevailing problems of corruption, violence, and impunity. The research argues that the existing legal framework is insufficient to guarantee the well-being and security of the citizenry, proposing instead the convocation of a Constituent Assembly to draft a new constitution. This new instrument aims to recover state autonomy, strengthen institutions against corruption, and ensure the effective protection of human rights, effectively redefining the relationship between the government and the governed. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, La distribución de las facultades impositivas en el sistema federal mexicano de acuerdo con la constitución política de los estados unidos mexicanos y el sistema nacional de coordinación fiscal.(2021) ;Zazueta Gutiérrez Carreras, Gabriel FrancoCruz Covarrubias, Armando EnriqueThis research work proposes to take a look at the federalism contravention in the magna carta on behalf of the Supreme Court of Justice of the Nation; this, based on the extensive interpretation that, in this regard, it makes in favor of the federation of article 73, section VII, in relation to article 124, both of the Political Constitution of the United Mexican States. Also, the insufficiency of fiscal resources available to the federal entities to defray their public expenditure based on said interpretation and its consequent creation of the National System of Fiscal Coordination, which aims to resolve the issue of tax competition, is observed. On the other hand, legal solutions and benefits for an adequate interpretation in relation to fiscal federalism in Mexico and, therefore, a different distribution of taxation powers between the different levels of Government are proposed. In this order of ideas, this analysis is carried out in the light of the Political Constitution of the United Mexican States of 1917 and the Fiscal Coordination Law in force, with the purpose of stablishing a new criterion of interpretation, in which the form of Government of the country and the sovereignty of the federative entities are respected. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, El control de convecionalidad y el principio IURA NOVIT CURIA. Elementos para facilitar su entendimiento y aplicación.(2021) ;Rosales Sánchez, Juan JoséVázquez Gómez B., FranciscoThis doctoral thesis analyzes ex officio conventionality control in relation to the iura novit curia principle, aiming to redefine its understanding and simplify its application to improve human rights protection within the Mexican legal system . The research argues that the current application of conventionality control has failed to meet the expectations of the 2011 constitutional reform because it is often erroneously limited to a compatibility check between national norms and the Inter-American corpus iuris . By examining the Inter-American System, the Mexican system of constitutional control, and comparative elements from Spain, the author proposes that conventionality control should be understood through the lens of iura novit curia—the judicial duty to apply the valid law applicable to a case, which inherently includes international treaties, regardless of the parties' arguments. The study concludes that treating conventionality control not as a separate mechanism but as an integral part of the standard judicial method for applying valid law resolves current conceptual inconsistencies and maximizes the effectiveness of human rights guarantees . - Some of the metrics are blocked by yourconsent settings

Item type:Publication, Contenido y alcance de la identidad de la persona sujeta a adopción internacional en México y su conformidad con el sistema internacional de derechos humanos.(2020) ;Miranda Delgado, María ElenaGonzález Marín, NuriaLegal research paper that studies the nature and scope of the Right to Identity of the adopted child and seeks to answer the following question: how does Mexican law protects the human right to know the biological origins of an adopted child and, is this protection in accordance with the international parameters? Recognized in 2014 as a human right by the Mexican Constitution, it studies the federal and local civil legislations to stress the intimate relation between the concepts of personal identity, kinship and community. It particularly focuses on the conformation of the Legal Identity by two other human rights: the right to a name and nationality. The study of the international instruments, universal and regional, shows the influence upon domestic legislation. It explores the intersection between the right to identity and international adoption, through a concrete case of identity transformation: the adopted child's right to know his/her biological origins as provided by the terms of the 1989 United Nations Convention on the Rights of the Child and the provisions of the 1993 Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption. This analysis is enriched by references to a special Spanish Act on international adoption and related jurisprudence from the Interamerican Court of Human Rights and the European Court of Human Rights. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, La necesidad de crear un tribunal constitucional en México.(2023) ;Pérez Rodríguez, Wendy Georgina ;Romero Martínez, EdmundoMiranda Torres, Roxana PaolaThis thesis argues for the necessity of creating a specialized Constitutional Tribunal in Mexico, contending that the current Supreme Court of Justice of the Nation (SCJN) is overburdened and compromised by a flawed hybrid model. The author posits that the SCJN's dual functions—acting as both the head of the ordinary judiciary handling legality appeals and as the primary body for constitutional control—results in an excessive workload that prevents it from effectively fulfilling its constitutional mandate. This problem is exacerbated by the highly politicized appointment process for justices, which relies on the President and Senate, thereby undermining the Court's independence and autonomy. Through a comparative analysis of other judicial systems, the thesis concludes by proposing the establishment of a new, autonomous Constitutional Tribunal, separate from the regular judiciary, which would be exclusively dedicated to constitutional matters and staffed through a depoliticized, merit-based selection process. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, Hacia un modelo de tributación colaborativa en México: La libertad responsable y el cumplimiento de obligaciones tributarias.(2022) ;Ochoa Torres, José LuisBejar Rivera, Luis JoséThis thesis proposes a paradigm shift in Mexico's fiscal policy towards a collaborative taxation model, arguing that the current adversarial and coercive relationship between tax authorities and taxpayers hinders effective revenue collection and social progress. Drawing on a multidisciplinary framework that integrates law, philosophy, and behavioral economics, the author posits that compliance should be rooted in "responsible freedom" and mutual trust rather than fear of punishment. The work analyzes the foundational principles of subsidiarity, solidarity, and good faith as essential pillars for restructuring the fiscal compact, emphasizing that the state should act as a facilitator in a system where enterprises are recognized as the primary creators of wealth. By examining international best practices, particularly cooperative compliance models from the OECD, the thesis advocates for a system that fosters dialogue, transparency, and reciprocity, thereby reducing conflict, enhancing voluntary compliance, and ensuring a more efficient and just use of public funds for the common good. - Some of the metrics are blocked by yourconsent settings
The Essential Values that Shape and Sustain Legal-Positive Federalism), examines the core values and principles that underpin this form of governance. The research posits that legal-positive federalism is more than a mere political or institutional structure; it is fundamentally sustained by a set of essential values that provide it with coherence and legitimacy. The study analyzes key concepts such as sovereignty, autonomy, and subsidiarity, tracing their historical evolution and their adaptation to modern political and social contexts. By moving beyond a purely formalist interpretation, the thesis argues that a robust and functional federal system requires a dynamic interplay of values such as pluralism, cooperation, and solidarity among its constituent parts. It concludes that the effectiveness of federalism hinges on a collective commitment to these principles, which are crucial for ensuring equitable governance, protecting local diversity, and fostering the common good. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, La razonabilidad jurídica de las restricciones político-electorales a los mexicanos por naturalización en el México contemporáneo(2023) ;Castillo Torres, GerardoGatt Corona, Guillermo A.This doctoral thesis, titled "COMPETENCIA Y COMPLEMENTARIEDAD ENTRE LA JUSTICIA CONSTITUCIONAL Y EL SISTEMA INTERAMERICANO DE DERECHOS HUMANOS: EL CASO DE LOS PUEBLOS INDÍGENAS DE AMÉRICA LATINA" (Competition and Complementarity between Constitutional Justice and the Inter-American Human Rights System: The Case of Indigenous Peoples in Latin America), analyzes the relationship between national constitutional justice and the Inter-American Human Rights System (IAHRS) concerning the protection of indigenous peoples' rights. The study explores the historical evolution of indigenous rights in Latin America and the legal frameworks that seek to protect them, arguing that these two systems of justice should not be seen as rivals but as complementary bodies that strengthen each other. The thesis uses a historical-analytical methodology to examine how the IAHRS has addressed the specific rights of indigenous communities, such as their rights to territory, collective property, and consultation, and how these decisions have influenced constitutional courts in the region. The author concludes that, for the effective protection of indigenous rights, a cooperative and complementary dialogue between national courts and the Inter-American Court of Human Rights is essential, as this approach contributes to the consolidation of a more robust, pluralistic, and inclusive legal order that respects the identity and culture of indigenous peoples. - Some of the metrics are blocked by yourconsent settings
