Item type:Publication, Reflexiones iusfilosóficas sobre posverdad, verdad y derecho Verdad ontológica en el derecho y temporalidad(Universidad de Extremadura, Servicio de Publicaciones, 2025)Truth has always been one of the most disturbing topics in the philosophy of law. Currently we are experiencing a crisis of truth framed in at least two phenomena: post-truth and virtual reality. Since there cannot be stable and prosperous societies or organ-izations without high levels of truth, it is necessary to constantly ask ourselves about the concept of truth. To this end, the article presents legal-philosophical reflections on the current problems, as well as an approach to the problem of truth in law. Subsequently, it questions the approaches that maintain that truth cannot be preached about law in gen-eral and norms in particular, to maintain that it is possible to preach it from the perspec-tive of ontological truth and temporality. Item type:Publication, Assertiveness and Human Rights Origins, Exercise, Education and Duties: How Assertiveness Can Help Us Better Understand Human Rights(Springer Nature Switzerland, 2024)This chapter will explore the relationship between assertiveness and human rights. The concept of “rights” is present in many definitions of “assertiveness”, in that being assertive means standing for one’s rights in a particular manner. In that sense, the author begins by explaining the origins of the relationship between the two concepts. Afterwards, he analyses the connection between human rights and assertiveness through three aspects that help better understand both ideas: first, what it means to exercise a right; second, how assertiveness can be explained through human rights education; and lastly, he suggests that to comprehend the two ideas better, it is necessary to also think in terms of “human duties”. ©The author. ©Springer. - Some of the metrics are blocked by yourconsent settings

Item type:Publication, Corporate Social Responsibility and Human Rights: Challenges in a Globalized Context(2020); This chapter aims to reflect upon the relationship between corporate social responsibility (CSR) and human rights. We argue that although CSR is a good attempt to propose better practices for managerial decisions, a human rights perspective enriches this vision. Therefore, the authors will define the meaning of a human rights perspective for business activities and, specifically, for CSR. The authors apply the idea of res extra commercium to human rights and CSR. As a first step, both factors need to be identified as moral absolutes. Business planning based on moral absolutes(2022); What happens when Corporate Social Responsibility (CSR) and Human Rights meet? This article argues that although CSR is a worthy attempt to propose social-aimed better practices for managerial decisions, a human rights perspective substantially enriches this vision. It also suggests that the ancient principle of res extra commercium can provide the rationale crucial to join CSR with human rights as a source of moral absolutes. Esta dinamicidad propia de los derechos humanos se observa, ya sea en el ámbito de la expansión normativa o en el de la interpretación. Procuran, así, responder a nuevas necesidades, intereses o circunstancias. Sin embargo, son también un fenómeno problemático que puede llevar a su proliferación artificial. Para ello, este artículo reflexiona en torno a las implicaciones jurídicas de concebir “nuevos derechos” y propone un test de autenticidad basado en la idea de tiempo, con el fin de abonar en la mejor comprensión de los auténticos derechos humanos. ©El autor ©Revista de Investigacoes Constitucionais ©Universidade Federal do Parana.
